Definitions

"Company", "we", "our", and "us" mean Projckt throughout our policies and terms.

"Services" means our websites, including SenseFolks, and every product created and maintained by Projckt, whether delivered through a browser, desktop app, mobile app, or another format. SenseFolks follows a Website → Survey → Insights model with six survey types: PricePoint, UserChoice, FeaturePriority, FastPoll, OpenFeedback, and Reaction.

"You" and "your" mean the people or organizations that own an account with one or more Services. The legal entity named during signup owns the account. If the organization is unincorporated, the person who signed up owns it.

Account terms

  1. You must keep your account and password secure and ensure your users do the same. The Company cannot and will not be liable for loss or damage caused by failure to meet this obligation.

  2. User Restriction Policy
You may not use the Services to:

    • Break laws or regulations.

    • Gather or use information from accounts that are not yours.

    • Deceive us or other users through false reports or impersonation.

    • Bypass or interfere with security features.

    • Overload or disrupt product configurations or operations.

    • Send or attempt to send viruses or malware, or add tracking tools such as web bugs and cookies.

    • Harass or threaten users or employees.

    • Defame, harass, or otherwise harm the Company, Services, or other users.

We may suspend or cancel accounts as needed to address these violations, unlawful activity, abuse, or security or reliability risks.

  3. You are responsible for all content and activity in your account, including that of your users.

  4. You must be human. Bots and other automated methods may not register accounts.

Payments, refunds, and plan changes

  1. Only the Free plan is available. It includes the Website → Survey → Insights flow and all six survey types. No credit card is required, and the plan does not expire.

  2. Paid upgrades, checkout, payment collection, billing cycles, and refunds are not available today.

  3. Before paid upgrades launch, we will publish prices, billing periods, taxes, and rules for plan changes, cancellation, and refunds. You can review those terms before choosing to upgrade.

Cancellation and termination

  1. You are solely responsible for canceling your account correctly. Follow our Cancellation Policy. An email or phone request is not automatically a cancellation. For help, email [email protected].

  2. Your content becomes inaccessible immediately after cancellation. We permanently delete it from active systems and logs within 30 days, and from backups within 60 days. Permanently deleted information cannot be recovered.

  3. We may suspend or terminate your account if we reasonably believe it violates these Terms or the law, abuses the Services, threatens security or reliability, or harms users or Company employees.

Suspension blocks you and your users from accessing the account and its content. Termination also deletes your account or your access to it, and all account content.

Where practical, we will try to notify the account owner first. We may act immediately to protect the Services, users, or others. See our use restrictions.

  4. Verbal, physical, written, or other abuse of Company employees or officers, including threats of abuse or retribution, will result in immediate account termination.

Changes to the service and prices

  1. We may modify or discontinue any part of the Services at any time, temporarily or permanently, with or without notice.

  2. When we change pricing, we tend to exempt existing customers. We may post notices on our websites or the affected Services.

  3. We intend to support the Services as far as possible and reasonable. If the Company or a Service is acquired or spun off, we will do everything in our power to keep the Services running.

Uptime, security, and privacy

  1. You use the Services at your sole risk, on an "as is" and "as available" basis. We take uptime seriously but do not offer service-level agreements.

  2. We may temporarily disable your account if your usage significantly exceeds other customers' average usage. We will contact the account owner first, except in rare cases where usage may harm performance for other customers.

  3. We protect data through backups, redundancy, and encryption, and enforce encryption for transmission over the public Internet.

  4. You agree that the Company may process your data only as described in our Privacy Policy. Our staff may occasionally access data for these reasons:

    • Support
We ask for express consent before accessing your account to help with a support request.

    • Failed automated processes
We receive alerts when errors interrupt processing. We fix and restart processes without viewing personal data where possible. Rarely, we must view the minimum personal data needed to fix the issue.

    • Security and abuse investigations
We review logs and metadata to protect your data and the Services. We may access accounts when necessary to investigate abuse reports.

    • Applicable law
As an Indian company with data infrastructure worldwide, we preserve or share customer data only when compelled by an Indian government authority through a legally binding order or proper request under applicable law, or in limited emergency circumstances.

Our default is to refuse non-Indian authorities' requests unless approved by the Indian government, which compels compliance through an established mutual legal assistance treaty or agreement. For tax audits, we share only the minimum billing information needed.

  5. We use third-party vendors and hosting partners for the hardware, software, networking, storage, and related technology needed to run the Services.

Copyright and content ownership

  1. All content posted on the Services must comply with Indian copyright law.

  2. The Company owns all rights, title, and interest in the Services, including intellectual property. Using the Services gives you no ownership rights.

  3. You need the Company's express written permission to duplicate, copy, or reuse any HTML, CSS, JavaScript, or visual design elements.

  4. Request permission to use Company or Service logos for promotion by emailing [email protected]. We may revoke permission if you violate these Terms.

  5. Without the Company's express written permission, you may not reproduce, duplicate, copy, sell, resell, or exploit any part of, use of, or access to the Services.

Service adaptations

  1. You expressly understand and agree that we are not liable for damages or losses resulting from your use of the Service.

  2. API abuse or excessively frequent requests may lead to temporary or permanent suspension of access. The Company determines abuse or excessive usage at its sole discretion. We will try to warn the account owner first, but may cut off access without notice if your API usage could cause or has caused downtime.

Liability

You agree that the Company is not liable to you or any third party for damages of any kind resulting from use of the Services, inability to access data, unauthorized access to your data or account, actions of third parties using the Services, or any other consequences related to these Terms or the Services.

By using SenseFolks, you agree to the Terms of Service, Privacy Policy, and related policies. For questions, contact us.
